Viraje judicial en Canarias: recupera su primera tasa turística

  • Alex Cuenca
  • 26 March 2025
🏖 The Mogán tourist tax in the Canary Islands, originally suspended on March 12, was reinstated by the Superior Court of Justice of the Canary Islands (TSJC). This tax, approved by Mogán's City Council on February 28 and applied starting March 12, charges 15 cents per night per person at hotels, apartments, and holiday homes. After a brief suspension, the TSJC ruled on March 20 that the economic harm claimed by the Hospitality and Tourism Business Federation (FEHT) could be compensated if their appeal succeeds, allowing the tax to remain in effect during legal proceedings.

  • Alex Cuenca
  • 26 March 2025
🛫 Fernando Clavijo, President of the Canary Islands, announced the central government's commitment to settling a €425 million debt with airlines for resident discounts by the end of the semester, with an additional forecasted expense of €1.25 billion in 2025, of which only €175 million is currently guaranteed. The regional government has advanced 25% of the maritime transport payment. This issue was highlighted by ALA President Javier Gándara, pointing out financial strains on airlines that threaten route connectivity within Canary Islands, Balearic Islands, Ceuta, and Melilla.

Boeing rechaza su culpa en los accidentes de los dos 737Max

  • Miguel Praga
  • 26 March 2025
💸 Boeing, acknowledging guilt in the 737Max accidents—one with Lion Air in Indonesia and another with Ethiopian in Africa—retracted its acceptance of culpability, affecting 346 fatalities. The company conspired to deceive the FAA during the investigation, a charge it initially admitted. Seeking leniency from the Department of Justice, Boeing leverages recent judicial reforms by the current government. The deception, possibly the deadliest crime in U.S. history according to a district judge, remains unresolved. Despite this, Boeing claims unrelated improvements in manufacturing and verification processes. After the Lion Air crash, Boeing blamed the airline, despite pilots being unaware of new flight control features.

Normas y reglamentos de los hoteles en el sector turístico

  • Eva Lacalle2
  • 26 March 2025
🏨 Hotel rules and regulations ensure guest safety and comfort, and uphold law and order, varying across hotels. Commonly, they cover check-in/out, ID and payment, noise and behavior, room occupancy, damages, tobacco use, pets, cleanliness, prohibited activities, external beverage consumption, privacy, and refund/cancellation policies. Check-in/out times are standardly communicated, with options for early check-in or late check-out for a fee. Noise and behavior rules aim to secure a peaceful environment. Occupancy rates are listed per room capacity, and exceeding limits may incur extra charges or penalties. Hotels often disclaim responsibility for personal items, providing safes in rooms, and may hold guests accountable for damages or theft. Clear pre-arrival communication of all policies is crucial to prevent misunderstandings.

Los abogados de CEHAT en el caso Booking defienden que sí ha habido daño

  • Hosteltur
  • 26 March 2025
🏨 Jaime Concheiro, socio director at CCS Abogados, outlines that Spanish hoteliers can join the European-led HOTREC project against Booking.com or opt for a faster Spanish initiative, with legal procedures starting as soon as May or June. Hoteliers have three options: join the European claim, pursue the Spanish initiative, or cede rights to a litigation fund after receiving €500 symbolically, potentially earning equal compensation upon case success. The claim filing fee is €300, and CCS Abogados would take a 30% cut from the indemnification. Already, 360 hotel businesses have registered, including a major chain, wary of sharing sensitive data or being the first large company to join. CCS plans to file the first lawsuits by early 2026, aiming for one per province with significant backing.

Cientos de viviendas en venta “con licencia turística inválida” en Benidorm y Alicante

  • Alex Cuenca
  • 24 March 2025
🏠 In the Comunidad Valenciana, the selling point "with tourist license" is increasingly common in real estate listings. However, the current regulations state that these licenses aren't transferable; new owners must reapply. The Decreto Ley 9/2024, enacted in August 2024, requires new owners to submit a declaration and a favorable municipal urban compatibility report. Over 480 properties in cities like Alicante, Benidorm, and others claim to have tourist licenses, which could mislead buyers. Municipal moratoriums up to two years complicate new licenses. Tourist licenses now expire after five years, with pre-existing ones ending in August 2029.
