AEDH vs. Booking.com: el reto legal y las dudas sobre el futuro de la plataforma

🏨 During the III International Meeting of Hotel Directors organized by the Spanish Association of Hotel Directors (AEDH), a legal battle against Booking for abuse of dominant position and anti-competitive practices was discussed. Alicia Reina expressed concerns about potential retaliation affecting visibility on Booking's algorithm. Booking has been designated as a "gatekeeper" under the EU Digital Markets Act, facing serious sanctions for abusive practices. Hotels may claim compensation for losses due to Booking's rate parity clauses, with potential claims up to 1.8 million euros for a hotel with an annual turnover of 4 million euros since 2010. Eskariam, working on a success basis, charges 25% of the recovered amount. The debate highlighted the heavy reliance of some hotels on Booking for room sales, and the possibility of similar claims against other OTAs like Expedia was suggested.

WTM 2024: Nuevas estrategias para un turismo más responsable e inclusivo

Sólo el 25% de las hoteleras ofrece formación específica en innovación

Medium-sized hotel chains (50-200 properties) lead in innovation budgeting compared to smaller and larger chains. However, only 10% have dedicated innovation directors, and 29% cite a lack of incentives and leadership as innovation barriers. Collaboration with startups and other industries is underutilized, with only 48% leveraging external expertise. The report recommends prioritizing creativity and problem-solving training to foster a continuous improvement culture. This barometer aims to be a strategic tool for identifying improvement areas and will be updated annually to benchmark innovation maturity.

La contrajugada de Booking a las disparidades de precios de los hoteles

On May 13, the EU designated Booking as a "gatekeeper" under the Digital Markets Act (DMA), influencing Booking to eliminate price parity clauses that limited hotels' ability to offer lower prices elsewhere. Booking will not explicitly penalize hotels with price disparities but will reduce their visibility, effectively penalizing them indirectly. In 2023, Booking invested nearly $7 billion in marketing, underscoring their significant financial commitment to attracting customers. The OTA's algorithm rewards hotels that maintain price parity with increased visibility and direct valuable customers to them. This persuasive algorithmic strategy aims to maintain Booking's market dominance without explicit retaliation against hotels with price disparities.
